1. Code of Conduct

Compliance with Applicable Laws in India

As a user of Consula, you agree to conduct yourself in a lawful, ethical, and respectful manner in accordance with all applicable laws and regulations in India. These include, but are not limited to:

  • The Information Technology Act, 2000 – governing the use of information technology and digital communication.

  • The Indian Penal Code, 1860 – addressing criminal conduct, including defamation, obscenity, and fraud.

  • The Indecent Representation of Women (Prohibition) Act, 1986 – preventing the portrayal of women in an indecent manner.

  • The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 – ensuring a safe and dignified platform experience for women.

  • Telemedicine Practice Guidelines issued by the Ministry of Health & Family Welfare, Government of India – regulating medical consultations conducted online.

By using our services, users agree to operate within these boundaries and understand that any breach may result in suspension or termination of service and, if necessary, legal action.

 

2. Nature of Services and Limitations

Online Doctor Consultations

Consula is an online platform that enables users to consult with verified and qualified Registered Medical Practitioners (RMPs) through digital means, including video, voice, or chat consultations. The platform matches patients with appropriate doctors using intelligent algorithms based on specialty, availability, and urgency.

This service is branded as “Consult” under the Consula platform.

Scope of Online Medical Advice

While digital consultations offer convenience and accessibility, they are limited in certain capacities, notably:

  • They do not replace physical examinations.

  • They do not offer emergency care or urgent life-saving interventions.

  • Medical advice is provided based on available digital health information, and outcomes may vary from in-person evaluations.

Important User Guidelines:

  • Maintain regular follow-ups with your offline/primary healthcare providers.

  • Do not use Consula for emergencies, serious injuries, or life-threatening conditions.

  • Ensure medical records, prescriptions, and diagnostic documents are uploaded and accurate for better clinical judgment.

 

3. User Responsibilities

Users of Consula are expected to:

  • Provide truthful and complete information during consultation sessions.

  • Refrain from impersonating others, submitting false reports, or misrepresenting medical conditions.

  • Use the platform only for lawful, ethical, and personal medical purposes.

  • Avoid uploading or transmitting any unlawful, vulgar, defamatory, discriminatory, or threatening content.

  • Understand and acknowledge that all communications and data shared may be reviewed by doctors for consultation quality purposes.

Violations of the above terms may lead to warnings, account restrictions, or immediate suspension or permanent banning from the platform, depending on severity.

 

4. Limitations of Service

Consula does not provide:

  • Emergency medical assistance.

  • Ambulance services.

  • Physical examination or surgical intervention.

Furthermore, service interruptions may occur due to:

  • Internet or connectivity issues.

  • Platform maintenance.

  • Errors in algorithmic matching or miscommunication due to language or interpretation.

Users acknowledge these limitations and are advised to exercise their own discretion and judgment while acting on medical advice provided digitally.

 

5. Prescription and Medicine Policy

 

Issuance of Digital Prescriptions

Prescriptions issued through Consula are:

  • Based on professional judgment of RMPs.

  • Shared electronically and stored within the user’s account securely.

  • Valid under Indian law but subject to conditions where certain medications—especially Schedule X drugs, narcotics, and sedatives—will not be prescribed.

Users may be advised to seek in-person consultations for such prescriptions.

 

Non-Sale of Medications

Consula does not sell, store, or distribute any pharmaceuticals. However, it may:

  • Provide users with the option to share prescriptions with third-party pharmacies listed on the platform.

  • Facilitate delivery via those third-party providers, who are independently responsible for compliance with pharmacy laws, drug quality, and shipping standards.

 

 

6. Communication and Notifications

Consula will use:

  • SMS, WhatsApp, Email, and In-App notifications to update users about:

    • Appointment confirmations

    • Doctor availability

    • Prescription details

    • Payment receipts

By signing up, users consent to receive these messages and understand that they are essential for service delivery.

 

 

7. Fair Usage Policy

Consula’s services are designed for individual and non-commercial use. Abuse includes but is not limited to:

  • Sharing accounts.

  • Repeatedly booking free consultations with false data.

  • Exploiting promotional offers fraudulently.

If detected, such activity may lead to:

  • Limiting access.

  • Permanent account suspension.

  • Withdrawal of any credits or benefits.

 

 

8. Payments, Pricing, and Refunds

All paid services will be:

  • Transparent in pricing, with full disclosure before booking.

  • Processed securely through trusted payment gateways.

Refund Policy

  • Payments are generally non-refundable unless:

    • A service was not delivered due to system error.

    • The doctor failed to attend the consultation and no reschedule could be arranged.

Users agree that Consula is not liable for gateway errors, bank delays, or double charges caused by external providers.

 

 

9. Prohibited Activities

Users are strictly prohibited from:

  • Posting or sharing illegal content.

  • Engaging in hate speech, threats, harassment, or discriminatory behavior.

  • Uploading viruses or malware.

  • Attempting to breach the platform's security.

Breaches may lead to legal action, suspension, or reporting to authorities.

 

 

10. Jurisdiction and Legal Indemnity

All services, transactions, and disputes shall be governed exclusively by the laws of India.

The courts of Latur, Maharashtra shall have exclusive jurisdiction.

Users agree to indemnify Consula (Rejuvenate Healthcare), its team, and medical professionals from any losses, damages, or claims arising from:

  • User misconduct

  • Inaccurate information provided

  • Misuse of advice

  • Third-party service disputes

 

 

11. Advertisement Policy

 

Third-Party Advertisements

  • Ads may appear from third-party brands.

  • Consula does not endorse or verify the quality, safety, or legality of these offerings.

  • Users are advised to use their judgment before purchasing or engaging with third-party content.

Internal Promotions

  • Ads by Consula are for promotional purposes and may involve subjective claims or marketing language.

  • Users should consult relevant product information independently before relying on claims made in promotional materials.

 

 

12. Confidentiality and Privacy

Consula ensures that all sensitive personal data and health information are:

  • Collected only with user consent.

  • Stored in accordance with applicable data protection laws.

  • Shared only under the following conditions:

    • Required by law or court order.

    • Permitted by user via written or digital consent.

    • Required by legal counsel for compliance or litigation purposes.

 

 

13. Changes to Terms of Use

Rejuvenate Healthcare reserves the right to update, change, or replace these terms:

  • Without prior notice.

  • By posting the revised version on the Consula website.

  • Users must review the terms periodically.

Continued use of the platform after changes implies user acceptance of updated terms.

 

14. Severability Clause

If any term or provision in this document is found invalid or unenforceable under applicable law, it shall not affect the enforceability of remaining provisions. The remainder of this agreement shall remain in full force and effect.

 

15. Survival of Obligations

Even after termination of service or deletion of a user account, the obligations related to:

  • Confidentiality,

  • Intellectual property,

  • User liability,

  • Payment obligations (if pending)

shall remain valid and enforceable.

Consula may contain links to third-party websites. These:

  • Are provided for convenience and informational purposes.

  • Do not imply endorsement by Consula.

  • Are not monitored or verified by Consula.

Users interact with third-party links at their own risk.
